1.-Delegation of Tourism of Marbella City Council informs the users of its portal www.marbellaexclusive.com that all the departaments of Marbella City Hall respect the current legislation on personal data protection, privacy of users and confidentiality and security of personal data, having adopted all the necessary technical and organizational measures to prevent the loss, misuse, alteration, unauthorized access and theft of personal data, according to the technology, nature of the personal data and the risks they are exposed to.

2.- In particular, the municipality of Marbella informs the user whose personal data are collected through the website marbellaexclusive.com, of the following:

• Existence of a file for the process of personal data
  

• Registration of the file in the Register of the Data Protection Agency
  

• Compulsory or optional nature of the answers to questions should they be raised, as well as the consequences of obtaining data or the refusal to supply them.

The use of the official website of the Tourism Department of the city of MARBELLA is free. However, the recruitment of some of the services provided by this website may be now or in the future, provided they pay the requested fee, in which case it will be clearly indicated.
Access to certain services is subject to user registration in the databases of the City Hall of MARBELLA. In these cases, the user must agree to use their access codes (username and password) in accordance with the following restrictions:

• The password set by the user, may not be contrary to morals and accept good practice nor damage the right to honour and reputation of others, nor in any way infringe industrial property rights and third party intellectual rights.

Its title gives, in accordance with Article 34 of Law 17/2001 of 17 December, Trademark, and in accordance with other laws that might be applicable, the exclusive right to use in trade. Therefore, their use is prohibited by third parties without authorization.
The possible presence here of symbols and trademarks outside the outlined ones in the preceding paragraph is without commercial purpose and with the authorization of their rightful owners, always with due respect to its exclusive rights.

5.2.- Domain Names
As mentioned in the preceding paragraph, the domain names "marbellaexclusive.com", "marbellaexclusive.es" and all those that serve to direct access to this official site are the exclusive property of the Town Hall of MARBELLA. The improper use of them would be an infringement of the rights conferred by registration and will be pursued by the means provided in the Act.

5.3.- Copyright
5.3.1 .- The contents, text, photographs, designs, logos, images, sounds, videos, animations, recordings, computer programs, source codes, and generally, any intellectual creation in this official site, as well as own whole site as a multimedia artwork, is protected as copyright legislation for intellectual property.

5.3.2 .- Belong to the Town Hall of MARBELLA all the economic rights for literary and artistic contributions created by the initiative, subject to the moral rights that correspond to their authors.

5.3.3 .- In accordance with the provisions of Art.129.2 the Spanish Intellectual Property Act, the Town Hall of MARBELLA has the reproduction rights, distribution and publication of the contents made under the same public domains..

5.3.4 .- In addition, the database consists of all digitized works in the website www.marbellaexclusive.com whose owner is the Town Hall of MARBELLA and which are protected by the sui generis right as refer in the Articles.133 and 134 of the Copyright Act and as agreed in the General Registry of Intellectual Property.

5.4 .- Reserve actions.
The user of this web site undertakes to respect the aforementioned rights and avoid any action that might harm them. Finally, information, presentation and services offered by this site may be subject to periodic or temporary changes, which may be carried out freely by the Town Council of MARBELLA without being obliged to communicate to users.
